Traducció comentada de la Llei dels testaments de 1837

Abstract

Aquest treball de final de grau detalla el conjunt d’activitats dutes a terme durant la traducció d’un text jurídic, en concret, la Llei dels testaments de 1837. Hem volgut reflectir totes les fases que engloben el procés traductològic. En primer lloc, la recopilació d’informació per la elaboració d’un marc teòric dedicat a la comparació de les dues cultures jurídiques implicades en la traducció i a l’anàlisi de les particularitats del llenguatge jurídic. A continuació, la recerca terminològica i l’elaboració d’unes fitxes amb els termes d’especialitat que hem considerat més destacables. Posteriorment, la lectura i anàlisi del text original, la consulta de textos paral•lels i de bibliografia sobre la redacció de textos jurídics en general i legislatius en particular en la llengua d’arribada per tal d’oferir una traducció fidel i, alhora, adequada a les normes, estil i convencions del català. Finalment, hem redactat un comentari traductològic que pretén detallar els diferents problemes als quals ens hem enfrontat i la justificació de les solucions emprades.

This final paper outlines the set of activities carried out whilst translating a legal text, specifically, the Wills Act 1837. Our aim was to reflect all stages of the translating process. First, to gather information in order to write a theoretical framework for comparing the two legal cultures involved in the translation, and also for studying the particularities of legal language. The next step consisted of the extraction of terminology and preparation of records of the most significant specialized vocabulary. Then followed the reading and analysis of parallel texts and literature about writing in the target language of legal texts in general, and of legislative texts in particular. All these stages were intended to deliver a faithful translation and, at the same time, to be appropriate to the norms, style, and conventions of Catalan. Finally, we present a written commentary on the translation which aims to explain in detail all kinds of issues that we had to deal with, and to justify the solutions adopted.
